Consent to the processing of personal data
I provide the above personal data through the contact form located on apsa.sk and for the purpose of handling suggestions and questions addressed to the controller. I also declare that all the information provided is true and the provision of the data is voluntary, based on my own decision. I give my consent for a limited period of 1 year from the last communication and I have the right to withdraw it at any time.
Purpose of the contact form
The contact form is used for the following purposes:
- To send questions and suggestions. In this case, consent to the processing of personal data is necessary, otherwise we will not be able to respond to the sent request and the sent personal data will be destroyed. Further information on the processing of personal data on the basis of consent is set out below.
- Those interested in business cooperation can also contact us via the form. In this case, consent to the processing of personal data is not required and the policy below does not apply to these persons.
This contact form is not intended for persons under the age of 16, nor is it intended for job applicants.
Principles for processing personal data of natural persons from the contact form
Pursuant to Article 13 of Regulation (EU) No 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, the controller is obliged to provide the data subject with information in connection with the processing of his or her personal data.
In order for us to process your personal data provided in the consent to the processing of personal data for the purpose of dealing with the suggestions and enquiries you send us via the contact form, we need your consent to the processing of your personal data, which you give us by ticking the checkbox. Consent is valid for 1 year from the last communication and can be withdrawn in writing at any time. Withdrawal of consent does not affect the lawfulness of the processing of personal data based on consent given prior to its withdrawal.
Providing consent is entirely voluntary, but unless you provide it, we will not be able to communicate with you about the message you have sent.
The personal data provided will not be subject to profiling or automated decision-making, and will not be transferred to third countries or international organisations.
Your personal data will be destroyed after the period for which you give us consent. Personal data may be disclosed or made available to the web hosting provider, the website administrator, the attorney/lawyer, controlling authorities and law enforcement authorities.

If the data subject's request is manifestly unfounded or unreasonable, in particular because of its repetitive nature, the controller may:
- charge a reasonable fee, taking into account the administrative costs of providing the information, or a reasonable fee, taking into account the administrative costs of notification, or a reasonable fee, taking into account the administrative costs of carrying out the requested action; or
- refuse to act on the request.
Rights of data subjects
1. Right of access of the data subject
The data subject shall have the right to obtain confirmation from the controller as to whether the controller processes his or her personal data. In particular, he or she has the right to know what personal data he or she processes and for what purpose, to whom he or she provides them, how long he or she keeps them, from what source he or she obtained them and whether he or she transfers them to third countries. The controller is obliged to provide the personal data to the data subject in the manner requested by the data subject.
2. Right to rectification
The data subject shall have the right to have inaccurate personal data rectified or incomplete personal data completed by the controller without undue delay
3. The right to erasure (right to be forgotten)
The data subject shall have the right to erasure of the personal data concerning him or her and the controller shall erase the personal data without undue delay if:
- the personal data are no longer necessary for the purposes for which they were collected or otherwise processed,
- the data subject withdraws the consent on the basis of which the processing is carried out and there is no other legal basis for the processing,
- the data subject objects to the processing which is carried out on the basis of the legitimate interest of the controller and there are no overriding legitimate grounds for the processing,
- the personal data have been unlawfully processed,
- the personal data must be erased in order to comply with a legal obligation under Union law or the law of a Member State to which the controller is subject.
4. Right to restriction of processing - in cases where:
- the processing of personal data is unlawful and the data subject requests restriction of processing instead of erasure of the data,
- the controller no longer needs the personal data but the data subject needs them to exercise a legal claim,
- the data subject objects to the processing of the personal data, pending verification that the legitimate grounds on the part of the controller outweigh the data subject's legitimate grounds.
Where the processing of personal data has been restricted, the controller may only process the personal data with the consent of the data subject or for the purpose of exercising a legal claim, for the protection of individuals or for reasons of public interest (does not apply to the storage of personal data).
5. Right to data portability
The data subject shall have the right to obtain personal data concerning him or her which he or she has provided to the controller in a structured, commonly used and machine-readable format and shall have the right to transfer such personal data to another controller if the data are processed on the basis of consent or a contract, are processed by automated means and the transfer is technically feasible.
6. The right to bring an action before the Data Protection Authority
The data subject has the right to lodge a petition in the event of:
- if the controller fails to act on his or her request to exercise the rights,
- if he or she suspects a violation of personal data protection by the controller, etc.
Notification of a personal data breach to the data subject
In the event of a personal data breach likely to result in a high risk to the rights and freedoms of natural persons, the controller shall notify the personal data breach to the data subject without undue delay.
Notification is not required where:
- the controller has taken appropriate technical and organisational protection measures and has applied those measures to the personal data concerned by the personal data breach,
- the controller has taken subsequent measures to ensure that the high risk to the rights and freedoms of natural persons is no longer likely to have consequences,
- it would require disproportionate efforts.
